Stiffer charges sought against alleged drunk driver

St. Clair County Sheriff Mat King says his department is working hard with the Prosecutor’s Office to ensure justice is served in the death of Port Huron Northern High School teacher Ashley Nisbett.

45-year-old Justin Simon is accused of driving drunk Friday morning on M-25 while he was heading north to go hunting. His vehicle crossed into the path of a southbound semi truck, causing his vehicle to spin, and then strike a second car. That vehicle was driven by Nisbett who was taken to a metro Detroit hospital for treatment of serious injuries. She passed away Tuesday as a result of her injuries. Simon was also treated for injuries at a Detroit area hospital and later arrested.

Simon, a Tennessee resident, was initially charged with of Operating While Intoxicated, Causing Incapacitating Injury. Those charges have since been amended to Operating While Intoxicated, Causing Death following Nisbett’s passing. The new charge carries with it the maximum penalty in Michigan of 15 years in prison and a ten thousand dollar fine. He is currently being housed in the St. Clair County jail and his bond has also been increased to $75,000 bond.
